The Principal Solicitor, Karen Weeks BJuris LLB (UNSW), has more than 24 years experience as a criminal defence lawyer in serious and minor criminal matters.

Karen personally attends to each and every task as a matter progresses from the initial enquiry to the final hearing and follow-up thereafter. Karen has pubished numerous papers on the intersection of criminal law and mental ill-health and two of her papers on section 32 applications have been published in the Law Society Journal.   They are used by other solicitors, barristers, some magistrates and judges. Click here for copies.

Section 32 applications are regularly run in the Local Court and in the District Court on appeal.

In the higher courts Karen has run successfull trials resulting in findings of not guilty on the grounds of mental illness resulting in conditional release. 

Fitness inquiries and stay applications have also been prepared for clients with serious mental illness and traumatic / acquired brain injuries.

For sentence matters in the Local and higher courts, Karen can arrange a comprehensive assessment and accurate diagnosis by a forensic clinical psychologist, neuropsychologist and/or psychiatrists.  Reliable and persuasive subjective material can be placed before a Court to mitigate sentence and ensure non-custodial options are considered.  Relevant treatment plans minimise the risk of re-offending.

Choosing the right lawyer to handle a simple or complex criminal matter in the Local, District or Supreme Court will be one of the most difficult decisions a person will face in their lifetime.  Leaving the decision to Google and dealing with large city firms can be daunting.

CMH Lawyers are providers of mental health legal services in some civil matters including advice and advocacy for those detained involuntarily or subject to a Community Treatment Order pursuant to the Mental Health Act 2007.  Karen appears in proceedings before the Mental Health Review Tribunal (MHRT) via AVL or in Gladesville.
